Understanding the Bankruptcy Process
Bankruptcy gives people the debt relief they need. However, not each type of bankruptcy is appropriate for every person. When I meet with clients, I take the time to understand their financial situation. I help clients determine which chapter of bankruptcy is most appropriate for their situation, such as:
- Chapter 7: Chapter 7 bankruptcy is ideal for people who cannot pay their debt and do not think they will be able to pay them in the future. This offers businesses and individual consumers liquidation of qualifying debts.
- Chapter 13: Chapter 13 bankruptcy is ideal for people who cannot afford to pay their debt immediately but think they will be able to pay it off over time. In this plan, a person's debts are reorganized into a payment plan and must be paid back over three to five years.
- Chapter 11: Chapter 11 bankruptcy is ideal for small businesses that want to stay in business while they file for bankruptcy. In this process, the business owner maintains control of the business operations, but the court oversees the financial aspects of the business.
